Who we are
FerbyTech, LLC is a software consulting and infrastructure company. We design, build, integrate, host, and operate software for our clients under individually negotiated agreements.
Client engagements are governed by their own contracts
Every FerbyTech client engagement is governed by its own written agreement, negotiated and executed by both parties before any work begins. Nothing on this website is an offer to provide services, and no services are provided except under such an executed agreement. If anything on this website conflicts with an executed client agreement, the executed agreement controls for that engagement.
Website content, including descriptions of our work and capabilities, is provided for general information only and does not create a client relationship, a warranty, or any commitment of services.
Cloud and dedicated infrastructure services
FerbyTech may provide cloud engineering, managed infrastructure, and dedicated server hosting under an executed service agreement. Hardware descriptions on this website are representative configurations, not a promise that a particular configuration is available. Final hardware, region, connectivity, maintenance, backups, storage protection, support, availability commitments, and pricing are documented in the applicable agreement.
"Unmetered" connectivity means that FerbyTech does not bill solely by the amount of data transferred under the applicable plan. It does not permit unlawful use, abuse, network disruption, resale, or activity outside the acceptable-use and capacity terms in the service agreement.
Acceptable use of the website
- Do not attempt to disrupt, probe, or gain unauthorized access to the website, our systems, or other users' data.
- Do not use automated tools to scrape, harvest, or bulk-download content from the website.
- Do not use the website to transmit malware, spam, or unlawful content.
Accounts and notifications
Where FerbyTech provides online accounts, you are responsible for keeping your credentials secure and for activity under your account. Optional SMS notifications are governed by the Mobile Terms of Service. The SMS Consent Process explains enrollment, and our handling of information is described in the Privacy Policy. We do not sell your information.
Intellectual property
The FerbyTech name, logo, and website content are the property of FerbyTech, LLC or its licensors and may not be used without permission. Ownership and licensing of software and deliverables created for clients are defined in each engagement's executed agreement.
Disclaimers
The website is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Website content is not professional advice.
Limitation of liability
To the fullest extent permitted by law, FerbyTech will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website. Liability arising from a client engagement is governed exclusively by that engagement's executed agreement.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms will be brought in the state or federal courts located in Florida, unless an executed client agreement provides otherwise.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date. Continued use of the website after changes take effect constitutes acceptance of the updated Terms.
